• A inconstitucional administração pós-constitucional do SUS através de normas operacionais Opinião

    Este artigo é uma opinião de quem, seja por motivo de ofício e cargo público, seja por militância profissional no campo da saúde, acompanhou e acompanha os passos da reforma sanitária brasileira. Trata do desenho institucional do setor saúde, no interior da seguridade social, um dos capítulos da Constituição Federal; da lei 8.080 que constituiu os desdobramentos expressos na Constituição; e analisa uma por uma as chamadas Normas Operacionais Básicas que foram criadas com a justificativa de dar seqüência, ou como o próprio nome indica, operar as transformações previstas na Constituição e na Lei Orgânica. Apresenta um olhar crítico que, possivelmente destoará da visão de outros atores também engajados neste processo. Mas sua intenção é incrementar o debate e contribuir para que, de uma vez por todas, a saúde seja considerada, no Brasil, direito de todos e dever do estado.

    This paper is the opinion of a health professional holding public office and participating directly in the health field, where he has accompanied the various phases in the Brazilian health reform process. The author analyzes the health sector's institutional design within the sphere of social security, a chapter in the Federal Constitution; Act 8.080, expressing the legislative development of the Constitutional concepts; and the so-called Basic Operational Norms that were created as the justification to proceed with (or as the term itself suggests, to operate with) the changes provided for under the Constitution and the National Health Act. The paper provides a critical view which may not coincide with that of other actors involved in this process, but the goal is to fuel the debate and contribute to a process by which, once and for all, health in Brazil will be considered the right of all and the duty of the state.
  • A política de saúde no Brasil nos anos 90 Opinião

    Os autores realizam uma reflexão sobre os rumos da reforma do setor saúde na década de 1990. Enfatizam a dinâmica de mudanças conjunturais e estruturais que, ao estigmatizar o sentido do Estado de Bem-Estar Social, acaba por minar as bases solidárias do projeto de seguridade social (no qual estava incluída a saúde). Fazem também a crítica ao modelo neoliberal que inclui, no seu interior, um pensamento privatista e focalizador sobre o setor saúde, quando comparado ao modelo e aos princípios do SUS. Mas ainda encontram vários elementos passíveis de serem articulados para revigorar o processo de construção da Reforma Sanitária que foi instituída na Constituição de 1988.

    The authors discuss trends in Brazilian health sector reform in the 1990s. They emphasize the dynamics of situational and structural changes which stigmatize the meaning of the Welfare State and thus end up undermining the basic solidarity characterizing the Social Security project (which included health). They also criticize the neoliberal model, which includes a privatist and narrow approach to the health sector, as compared to the model and principles of the Brazilian Unified Health System (SUS). Nevertheless, they identify various elements that can be used to reinvigorate the Health Reform process written into the 1988 Constitution.
  • A regionalização no contexto atual das políticas de saúde Opinião

    Este artigo trata da gestão do processo de descentralização do SUS na década de 1990, relacionando-o à construção e à aplicação das Normas Operacionais Básicas (NOB) que vigoraram de 1991 a 1996. O autor valoriza esses instrumentos de orientação para as três esferas de governo e sua "pactuação", mas também discute os seus limites, sobretudo, relacionados à complexidade e às diferenciações de avanço dos estados e dos municípios, no processo de implantação do SUS. Por isso mesmo considera o esgotamento das NOBs para a situação presente da dinâmica da descentralização setorial. Sua atenção se centra em outro instrumento: Norma Operacional de Assistência à Saúde (NOAS SUS 01/01) para a qual se busca um consenso mínimo entre todos os atores responsáveis pela reforma setorial: o Ministério, as Comissões Bipartites e Tripartites e o Conselho Nacional de Saúde. A partir da crítica da NOB-96, o autor propõe que se acentue a lógica de garantia de acesso da população às ações e aos serviços de saúde em todos os níveis de assistência.

    This article deals with the management of the decentralization process in the Brazilian Unified Health System (SUS) in the 1990s, relating it to the establishment and application of the so-called Basic Operational Norms (NOB) in force from 1991 to 1996. The author highlights the usefulness of these instruments for orienting the three levels of government and their negotiation, while also discussing their limits, particularly those pertaining to the complexity and different degrees of progress experienced by the various States and municipalities in implementing the Unified Health System. For this very reason he contends that the NOBs have run their course in terms of the current dynamics of health sector decentralization. He focuses attention on another instrument, the so-called Health Care Operational Norm (NOAS SUS 01/01), around which a working consensus is currently being sought among the key actors in health sector reform: the Ministry of Health, the Bipartisan and Tripartisan Committees, and the National Health Council. Based on the critique of the NOB-96, the author favors further promoting the logic of guaranteeing the population's access to health services and programs at all levels.
